Profile

    Robert Wisner is a partner in the Litigation and Dispute Resolution group of McMillan LLP. His practice focuses on international arbitration and litigation, foreign investment protection and international trade. Robert is recognized in “Who’s Who Legal” and “Best Lawyers in Canada” in the area of international arbitration.

    Robert has argued cases involving businesses and governments from around the world before international arbitral tribunals established under bilateral investment treaties, NAFTA and international commercial contracts. Robert has also appeared at the trial and appellate levels of the Ontario and Federal courts in international, corporate-commercial and competition litigation.  His international trade and competition law experience has included representing clients before federal government departments and agencies. 

    In addition to his advocacy work, Robert provides advice to international businesses on foreign investment protection, market access, government procurement, economic sanctions, political risk insurance, anti-bribery and other international treaty issues. Prior to practicing law, Robert served as an economist in the Investment Policy Division of Canada’s Department of International Trade.

  • Counsel in ICSID bilateral investment treaty arbitrations against states in Latin America and Eastern Europe arising out of the energy, steel, financial services and airport services sectors
  • Counsel in UNCITRAL NAFTA arbitrations against the government of Canada arising out of the courier, forestry and environmental services sectors
  • Counsel in ICC, SCC and CIETAC commercial arbitrations and related litigation involving parties in Canada, Western Europe and Asia
  • Appearing before the Ontario Superior Court and Federal Court of Canada in disputes relating to international arbitrations and foreign litigation
  • Advised clients on foreign investment protection, economic sanctions, anti-bribery, extraterritorial legislation and NAFTA, Energy Charter Treaty and WTO provisions relating to
  • mining, electricity, oil & gas, agriculture, postal services and government procurement
  • Counsel to complainants and respondents before the Canadian Competition Bureau and in related litigation involving distribution and pricing practices
