Don Short is certified by the Law Society as a Specialist in Civil Litigation and chairs his firm’s Toronto Construction Law Group. He is engaged in the practice of commercial and construction litigation as well as a broad range of insolvency related matters. In addition, he has been actively involved in the implementation of ADR in the Ontario Court and presently serves as a Director of the ADR Institute of Canada. He is listed in the Euromoney Guide to the world’s leading experts in arbitration. He has been recognized as well by both Lexpert and The Best Lawyers in Canada for his Construction law and ADR skills.

Don was asked by the Regional Chief Justice to serve on the Task Force which was responsible for the development and implementation of Canada’s first court-annexed Alternative Dispute Resolution Pilot Project. Following the establishment of the Province’s ADR Centre, he continued to be an active member of the Centre’s Steering Committee and he is now a member of the Toronto Local Mediation Committee. Don chaired the joint program to introduce ADR to the profession on behalf of the Law Society of Upper Canada and the Ontario Court (General Division). He has been a frequent speaker on the values of ADR and was involved as counsel in the leading case dealing with the enforceability of contractual arbitration provisions, Automatic Systems Inc. v. Bracknell Corp., 18 O.R. (3rd) 257 (Ontario Court of Appeal, 1994).

He has served as mediator on major construction disputes involving parties such as The Municipality of Metropolitan Toronto. He has acted as counsel in major arbitrations and recently served as Chair of an Arbitration Tribunal appointed by the International Chamber of Commerce dealing with a dispute between American and German companies.

He has served on the Provincial Executive of the Canadian Bar Association and chaired both the Ontario Bar Association’s Annual Institute of Continuing Legal Education and the OBA’s Civil Litigation Section. He has chaired the province’s most attended CLE program, Operation Update, since its inception in 1991.

He has chaired a number of construction programs including the Annual Construction Superconference, Construct Canada and the CBAO Construction Contract Roundtable. He has lectured to the Bar Admission Course and has chaired and participated in a number of Law Society and Bar Association programs.
